Visas and work permits

Thailand work permits: employer evidence and immigration status

Permission to stay and permission to work are separate. The correct application depends on nationality, the employment activity, employer and any applicable exception. A change of employer, duties or workplace needs review under the current employment and immigration rules; do not assume every change has the same notification or cancellation consequence.

Short answer

Determine the immigration category and lawful employment route before fixing a start date. Capital and Thai-staff criteria for an ordinary business extension of stay are not a universal work-permit formula. BOI and other categories have their own evidence and approvals. Check the Department of Employment filing channel and the immigration requirements separately; neither timing nor approval is guaranteed.

The employer qualifies before the employee does

Prepare employer evidence for the actual application route: business registration, paid-up capital where required, operating premises, payroll, tax and social security records. Compare those records with the proposed duties and business activities. Inconsistent headcount or contribution records need explanation and correction; this page does not claim a refusal rate or automatic rejection rule.

For an ordinary business-based extension of stay, immigration criteria commonly include THB 2 million paid-up capital and a four-to-one Thai employee ratio, subject to specified exceptions and category rules. These are not the statutory formation requirements of every company or a universal condition for every employment permission.

The job description is the part clients treat casually and officers treat literally. Compare the actual duties with applicable work restrictions and any permission or notification requirements; do not rely on an invented job title to evade a prohibited occupation. We write the description broadly enough to reflect the real role and narrowly enough to stay within the reserved-occupation restrictions in Thai law.

Every file is assembled and checked before anything reaches a Thai authority.

Sequence, timing and the mistakes that reset the clock

The sequence depends on the route: some applications require employer-side pre-approval documents before a visa application. Non-Immigrant B may be obtained overseas or through an eligible in-country status change, while other lawful categories have distinct rules. Check remaining stay, the receiving office and required evidence; a tourist entry is not itself permission to work.

Once the permit is issued, three separate calendars begin and none of them reminds you. The permit itself has an expiry. The visa extension has a different expiry and is granted by the immigration office on evidence of continuing employment, tax payment and company standing. Ninety-day reporting runs independently of both. Missing the ninety-day report attracts a fine; an expired permission to stay creates an overstay issue that requires immediate case-specific advice, not an assumed automatic restart procedure.

Prepare renewal evidence before the actual expiry dates, without assuming all permissions last a year. Depending on the route, authorities may require withholding tax certificates, social security filings, audited statements and staffing evidence. Differences between declared salary and actual payroll require explanation and correction.

Families, changes and the practical detail nobody mentions

Review dependants under the primary holder's actual immigration category: family relationship, age limits, financial evidence and document requirements can differ. Marriage and birth records may need translation or authentication in the receiving office's prescribed form. Dependant status alone does not grant ordinary employment permission; assess any proposed work separately.

Before changing employer, establish the required employment notifications or application and the effect on the present extension of stay. Ending the employment that supports a stay permission may require immigration cancellation or a new application. Do not rely on an automatic grace period or assume two employment filings can always overlap.

For an office move or a change in duties, check the current notification obligations and any sector or category restrictions before implementation. Corporate amendments, employment records and immigration evidence should remain consistent, without assuming one amendment procedure covers every change.

How the work runs, step by step

  1. Step 1

    Employer eligibility check

We review paid-up capital, Thai headcount and social security filings, registered objectives and the office, and fix any gap before an application is exposed to an officer.

  2. Step 2

    Visa strategy and application

Non-Immigrant B obtained abroad or converted in Thailand where permitted, with the invitation and employment documents prepared in the form the consulate concerned expects.

  3. Step 3

    Work permit filing

Check the Department of Employment e-Work Permit system and the current channel for the applicant category. Prepare the required employer and personal evidence, then follow any identity verification, appointment and collection instructions. Special-category applications may use a different approved workflow.

  4. Step 4

    Extension of stay and reporting

Review eligibility for an extension of stay with the immigration office and prepare employment and tax evidence. Track the granted expiry, any re-entry permission and ninety-day address reporting separately; reporting does not extend stay or employment permission.

  5. Step 5

    Dependants and category-specific renewal

Review family eligibility and each permission's expiry. Prepare the payroll, tax, social security and corporate records required for the applicable renewal, without treating every family or worker category as an annual application.

What you send us

  • Passport and immigration pages required by the receiving office; check route-specific remaining-validity requirements.
  • Qualifications and experience evidence where required for the occupation or personnel category.
  • Photographs and medical evidence in the form required by the relevant application checklist.
  • Employer evidence required for the route, which may include registration, shareholders, accounts, VAT and social security records; not every employer has an identical checklist.
  • Employment contract stating position, duties, salary and place of work.
  • For dependants: relationship records with translations or authentication where the receiving authority requires them.

Where things usually go wrong

Working before the permit is issued

A visa alone does not authorise ordinary employment. However, specified meeting, seminar or business-visit activities may fall outside permit requirements; assess the actual activity and applicable exception rather than labelling every meeting unlawful.

Declared salary above the salary actually paid

Compare declared salary with actual payroll and withholding certificates. Explain and correct inconsistencies before filing; no claim is made that a mismatch is the most common refusal reason or always produces the same decision.

Thai headcount ratio slipping mid-year

Monitor staff evidence where the applicable immigration category requires it. A headcount change should trigger review, not an assumption that every renewal is automatically refused.

Duties drifting beyond the permit

Review actual duties against current restrictions and any conditions on the permission. Establish what must be notified or approved instead of assuming every internal duty change invalidates the permit.

Questions foreign clients actually ask us

Can I convert a tourist entry into a work permit without leaving Thailand?
An eligible in-country change to Non-Immigrant B may be available subject to immigration requirements, remaining stay and complete evidence. Changing immigration status is not itself issuance of a work permit. If that route is unavailable, review overseas visa options and employment approval requirements without assuming a faster outcome.
Which jobs are closed to foreigners?
Check the actual duties against the Ministry of Labour's prohibited-work notification and any conditional categories, treaties or professional licensing requirements. Do not label all manual work, trades or accountancy identically: different restrictions and exceptions may apply. A management title cannot legalise prohibited duties.
Does my company need four Thai employees before I can hire one foreigner?
A four-to-one ratio appears in ordinary business-based immigration extension criteria, with exceptions. It should not be stated as a universal work-permit prerequisite. Review employer capital, staffing and category-specific rules with both immigration and employment requirements in view.
What happens to my visa if I resign?
Assess cancellation or notification with the Department of Employment and the effect on immigration permission before the last employment date. There is no automatic grace period assumed here. Arrange any next application around the actual permission and agency instructions.

Send us the company's registration documents, the current Thai headcount, and a short description of the position to be filled. We can then confirm whether the company qualifies today, what needs fixing first, and a realistic start date for the person you are hiring — including the family visas if they are moving with you.
