Bail & Provisional Release at Every Stage in Thailand

Provisional release filed inside the deadline, with security the court accepts.

Quick answer

Bail is provisional release during investigation or trial, available from the police stage through the prosecutor to every court level. Security may be cash, a land title, a deposit book, a civil-servant position, or a liberty-insurance certificate; the amount tracks the charge and its penalty range. We can attend from the moment charges are read. Handling fee from THB 20,000, separate from the security itself.

From THB 20,000 From 20k per stage, excluding the security and any liberty-insurance premium · Filed same day when documents are complete; the order usually issues that working day

How it works

5-step process

  1. 1

Take the matter and pin the stage

Establish whether it sits at investigation, detention, or court stage — different authorities decide.

  2. 2

Assess the amount and form of security

Match the penalty range to that court's bail scale, then pick the security you can produce fastest.

  3. 3

    File and attend the hearing

Show no flight risk, no interference with witnesses, and a settled address.

  4. 4

Collect the accused and explain conditions

Set out the restrictions, reporting dates, and the consequences of any breach.

  5. 5

    Carry it through to trial

Extend or adjust security as the case moves stage, and build the defence in parallel.

In depth

Bail & Provisional Release at Every Stage: what foreign clients need to know

Bail work is measured in hours, not days. The period a suspect may be held is bounded by law, and getting security in place before the investigating officer must take him for a detention hearing is what separates going home that night from waiting in prison for the next listing. That is why bail calls jump the queue in our office.

The three stages of release, and who holds the power at each

First comes the police stage, where the station commander or his delegate decides. Second is the prosecutor stage once the file moves across. Third is the court stage, once a detention request or an indictment is filed. Each stage uses a different application form, a different decision-maker, and different security expectations.

The most common misstep is a family readying security for the court stage but missing the police stage, so the suspect is remanded needlessly. We therefore ask three things the moment the call comes in: the hour custody began, which station, and the charge as notified.

Security that is actually accepted, and the amounts usually asked

Accepted security includes cash, a passbook with the bank confirming the balance, a land deed with its appraisal certificate, a letter from an employer or government agency, and a bail insurance policy. Preparation time differs sharply: cash works immediately, while a deed first needs an appraisal certificate from the land office.

The amount tracks the penalty range, the circumstances, the loss, and the record of attendance. Cases where the injured party has already received part compensation usually draw a lower figure, so we file evidence of that responsibility alongside the application — it weighs more with the decision-maker than pleading does.

Duties after release, and why bail gets revoked

A person released on bail must attend every listing, must not interfere with witnesses, and must observe any conditions imposed, such as a travel ban or periodic reporting. A single unexplained absence can forfeit the security and trigger an arrest warrant at once.

We set date reminders for both the accused and the surety, and where attendance is genuinely impossible — an emergency illness, say — we file a postponement request with the medical certificate in advance rather than letting it become a default.

Cost structure: government fees vs professional fees

Release secured on night one, before the remand deadline

Situation: The family called at dusk; the suspect had been in custody for hours with no security at all.

What we did: We had them ready a passbook with the bank confirming funds while our team attended the officer to file.

Outcome: Release was granted the same night, with no remand stage at all.

A successful second application after the first was refused

Situation: The first request failed over a flight-risk concern.

What we did: We refiled offering passport surrender, a higher amount, and an employer letter confirming steady work.

Outcome: The court granted bail with reporting conditions; the defendant attended every listing through to the end.

When to act, and when waiting is fine

  • Call a lawyer the moment you learn of the custody

Every hour that passes narrows the chance of filing in time at the police stage.

  • Use a bail insurance policy when cash is not ready

The premium costs less than losing days while a lump sum is assembled.

  • Pair compensation talks with the bail application

A responsible posture affects both the amount set and the outcome later at trial.

  • Refile when the first application is refused

You must offer new conditions that answer the stated concern, not resubmit the same text.

FAQ

Frequently asked questions

How does police-stage bail differ from court bail?

At investigation the officer decides and the figure is usually lower; once charges are filed the court decides and a fresh petition is needed.

No cash for security — what then?

Use a deed, deposit book, civil-service position, or buy liberty insurance where the premium is a fraction of the sum.

If bail is refused, is that final?

No — refile when circumstances change, and appeal the order to the higher court within the deadline.

What happens if conditions are breached?

The court fines the surety under the bail bond, may enforce the security, and issues an arrest warrant.

When is the security returned?

Once the case concludes and no breach occurred — we handle the release application.

Can foreigners get bail?

Yes, though flight risk is scrutinised harder — expect higher security and passport retention.

How many hours does bail take?

With security ready, the police stage usually resolves in 2–5 hours; the court stage depends on that day's list.

Can a land deed be used as security?

Yes, but it needs an appraisal certificate from the land office, which adds preparation time.

If the defendant absconds, does the surety lose everything?

The security is enforced up to the amount pledged, so weigh the risk before standing surety.
