Frequently asked questions

What endowment does a foundation need?

The registrar sets a minimum, and where the dedication is land or other property rather than cash a valuation must be attached; in practice most offices still expect part of it in cash.

May foreigners sit on a Thai foundation committee?

They may, though registrars in practice expect a reasonable proportion of Thai nationals and often ask for extra residence and background documents for foreign members.

Can a foundation earn income?

It can where the income supports the objects and is not distributed to the committee, but regular commercial activity may be taxed and can jeopardise charitable status, so the accounts should be clearly separated.

Can donors deduct as soon as the body is registered?

Not yet: the body must first be listed as a public charitable organisation by the Ministry of Finance before receipts carry deduction rights.

How soon must a committee change be reported?

The change must be lodged with the registrar without delay after the resolution, because the incoming committee lacks authority towards third parties until it is recorded.

Where do the assets go when a foundation closes?

They pass to a body with similar objects as named in the instrument, and where nothing is named the court decides the destination; they do not revert to the founder.
